End-User License Agreement

This End-User License Agreement ("Agreement") is between you and Super Locrian LLC ("we", "us") and governs your use of the NitePix desktop application (the "App").

1. License

Subject to this Agreement and payment of the applicable fee, we grant you a personal, non-exclusive, non-transferable license for one person to install and use the App on up to two devices you control, for any purpose including commercial performance (VJing, live shows, installations).

Output you create with the App (show visuals, recordings of your performances) is yours; we claim no rights in it. Note that recordings that include bundled MilkDrop presets include the rendered output of community-authored works — see Section 5.

2. Restrictions

You may not: (a) redistribute, resell, rent, or sublicense the App; (b) reverse engineer it except where law permits; (c) extract and redistribute the bundled preset pack as a collection; (d) remove copyright, credit, or license notices from the App.

3. Photosensitivity warning — read this

THE APP PRODUCES INTENSE FLASHING LIGHTS, STROBE-LIKE EFFECTS, AND RAPIDLY MOVING PATTERNS. A SMALL PERCENTAGE OF PEOPLE MAY EXPERIENCE SEIZURES TRIGGERED BY LIGHT PATTERNS LIKE THESE, EVEN WITH NO PRIOR HISTORY OF EPILEPSY. Stop using the App immediately and seek medical attention if you experience dizziness, altered vision, eye or muscle twitching, loss of awareness, or disorientation. If you use the App to perform for an audience, you are responsible for appropriate venue warnings and for complying with any local requirements on strobe effects.

4. Your content

The App can load audio, video, camera input, and MilkDrop .milk preset files that you supply. You are solely responsible for the content you load and perform with — including having the rights to any presets you import and any music you perform to. Imported content is processed locally and is not transmitted to us (see the Privacy Policy).

5. Bundled presets and third-party components

The App includes MilkDrop presets created by a community of authors, who retain copyright in their work; they are bundled with attribution and a standing takedown offer (see the in-app Credits screen). Preset availability may change between releases — we remove presets on author request, and this is not a defect. Open-source components ship under their own licenses; see the Third-Party Notices in the App.

6. Updates, refunds, and takedown-driven changes

Your license is perpetual for the version of the App you purchased. We may release updates, and which updates are included with your purchase is at our discretion — no future features are promised. Updates may remove or rename bundled presets to honor author requests; this is not a defect.

7. No warranty

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE. Live performance carries inherent technical risk; test your full setup before any show.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES — INCLUDING LOST PROFITS, LOST BOOKINGS, OR INTERRUPTED PERFORMANCES — ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow these limitations; they apply to the fullest extent permitted.

9. Termination

This Agreement ends automatically if you materially breach it. On termination you must stop using and delete the App. Sections 4–5 and 7–10 survive.

10. General

This Agreement is governed by the laws of the State of New York, without regard to its conflict-of-laws rules. It is the entire agreement about the App and supersedes prior discussions. If a provision is unenforceable, the rest remains in effect.
