By using the NitePix web app at nitepix.superlocrian.xyz (the "App"), operated by Super Locrian LLC ("we", "us"), you agree to these terms. The App is served statically, with no accounts, no uploads, and no server-side processing — which keeps these terms short.
The App is free to use in your browser for personal, non-commercial purposes. It is not intended for commercial use — paid gigs, club installations, ticketed shows, or other for-profit performance. For commercial use, get the NitePix desktop app, which is licensed for commercial performance and built for it.
THE APP PRODUCES INTENSE FLASHING LIGHTS, STROBE-LIKE EFFECTS, AND RAPIDLY MOVING PATTERNS THAT MAY TRIGGER SEIZURES IN PEOPLE WITH PHOTOSENSITIVE EPILEPSY, EVEN WITH NO PRIOR HISTORY. Stop immediately and seek medical attention if you experience dizziness, altered vision, twitching, loss of awareness, or disorientation. If you show the App's output to others, you are responsible for warning them.
Audio, camera input, and imported preset files are processed entirely in your browser and never uploaded to us (see the Privacy Policy). You are responsible for the content you load, including having the rights to music you play and presets you import.
Bundled MilkDrop presets remain © their community authors; see the in-app Credits. Authors can request credit fixes or removal at any time and we honor such requests in subsequent releases; availability of any given preset is not guaranteed.
THE APP IS PROVIDED FREE AND "AS IS", WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPER LOCRIAN LLC IS NOT LIABLE FOR ANY DAMAGES ARISING FROM USE OF THE APP; IN ANY CASE TOTAL LIABILITY IS LIMITED TO USD $0 FOR THE FREE APP. Some jurisdictions limit these disclaimers; they apply to the fullest extent permitted.
We may change or discontinue the free App at any time. These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.
The NitePix desktop app for Mac is a separate, paid product sold by Super Locrian LLC with Paddle.com as merchant of record. It is governed by its own End-User License Agreement, not these terms, and refunds for it are covered by our Refund Policy.
